I therefore deny the motion as premature without prejudice to renewal after further good faith efforts to resolve the matters on consent. I respectfully suggest to the parties that there are easily achievable accommodations that will allow each side a fair opportunity to litigate the merits of the case, and I will take that into consideration, should the motion be renewed, in applying Federal Rule of Civil Procedure 37(a)(5).
