Filing 11 AFFIDAVIT of Service for Check , filed by Conor Flynn, International Flynn, LLC. (Liebowitz, Richard) |
Minute Entry and Order for Initial Status Conference held before Judge Brian M. Cogan on 7/11/2019. Counsel for plaintiffs present. Defendants' counsel failed to appear despite notice of the conference. Defendants' counsel is therefore sanctioned in the amount of $425, payable to plaintiff's counsel within 7 days of the date of this Order to compensate plaintiff's client for the waste of time, with proof of payment filed on the docket of this case. The initial status conference is adjourned to 7/31/2019 at 11:15 am in Chambers 704S. (Weisberg, Peggy) |
Filing 10 Letter (Joint) by Parties Per Mandatory Rqmts. for the Initial Status Conf. by Coffee Rx, Inc., DW Branding, Inc., GS Coffee, Inc. (Etufugh, Alozie) |
ORDER re: #6 . The parties have failed to file a joint letter in advance of the initial status conference consistent with the Court's prior Order. Defendants' cookie-cutter answer generally denying all allegations in the complaint is not useful to the Court: plaintiffs have given a thorough description of their version of events in the complaint, and defendants have not explained their position to the contrary, so the Court has no reason to believe that there is any possible alternate explanation. The purpose of the initial status conference is to isolate the meritorious areas of litigation and streamline an efficient discovery and dispositive motion schedule targeted to those issues. The parties are therefore directed to file a joint letter in compliance with this Court's individual rules by 7/9/2019. Ordered by Judge Brian M. Cogan on 7/9/2019. (Clarke, Melonie) |
Filing 9 CASE MANAGEMENT STATEMENT (Etufugh, Alozie) |
Filing 8 First MOTION to Adjourn Conference by Coffee Rx, Inc., DW Branding, Inc., GS Coffee, Inc.. (Etufugh, Alozie) |
ORDER denying #8 Motion to Adjourn Conference. The Court does not delay litigation pending settlement discussions as the parties are free to settle at any time. If the parties want to settle before the conference, they can. Otherwise, they can expect to be put on a prompt discovery and trial schedule. Ordered by Judge Brian M. Cogan on 6/28/2019. (Weisberg, Peggy) |
