ORDER TO ANSWER: Plaintiff has failed to timely respond to the court's Order to Show Cause as to why this matter should not be transferred to the Southern District of New York. ORDER TO SHOW CAUSE: Plaintiff's request for a certificate of default is denied without prejudice to renew, and the Clerk of Court shall not issue a certificate at this time. Plaintiff is ORDERED to show cause why this case should not be transferred to the Southern District of New York as no facts alleged in the Complaint indicate venue lies in this District. Plaintiff shall respond by letter submission no later than July 17, 2019. Moreover, a review of the executed summonses in this action indicate service of process was perhaps insufficient. As to the corporate defendant, there are no allegations in the complaint that indicate defendant Jihoon Jeong is the owner of Loui Amsterdam. A search of the New York State Corporate Entity database also does not indicate Jihoon Jeong is a registered agent authorized to receive service on behalf of the corporate defendant. As to the individual defendant, the affidavit of service does not indicate Jeong was served a copy of the Complaint as required by Fed. R. Civ. P. 4(c)(1). Plaintiff shall address these deficiencies in his response to the Order. Finally, plaintiff shall serve a copy of this Order on defendants and file proof of service on the docket by July 12, 2019.
