Defendants motion #77 for reconsideration is GRANTED in part. Because the Court finds that Plaintiff lacks standing to seek injunctive relief, Plaintiffs request for injunctive relief is STRICKEN. May 24, 2021 Minute Entry: Telephonic-Discovery Conference held on 5/24/2021 before Magistrate Judge James R. Cho. John Sardesai-Grant and D. Greg Blankinship appeared for plaintiff; Lori Semlies appeared for defendants. The Court heard argument on the three issues raised in the parties' joint discovery letter dated 5/19/2021 (DE #87 ). The Court is guided by the prior rulings limiting the scope of discovery generally to the period of Chow's residency at the facility in question (Dkt. entry dated 1/20/2021), and the exceptions set forth in the Court's 7/21/2020 Order (DE #62 ). The Court made the following rulings: First, plaintiff requested email data for August 2017 to the present because defendants are no longer in possession of emails prior to July 2017. See Issue # 1. The Court denied plaintiff's request as to production of emails on the grounds that plaintiff failed to make an adequate showing that emails on or after August 2017 were relevant to the case, but granted leave for plaintiff to refile their request, if necessary. Second, plaintiff requested production of certain "Minimum Data Set" assessments and "payroll punch detail" to verify third-party data for the post-August 2017 period. See Issue #2. According to plaintiff, the data demonstrates level of staffing at the facility in question. See Issue #2. The Court denied plaintiff's request on the grounds that obtaining the data, in light of the articulated difficulties in obtaining the data, was not proportional to the needs of the case, but granted plaintiff leave to renew the request in the event defendant sought to challenge the veracity of the third-party data. Third, plaintiff requested expanding the temporal limitations of the discovery period in light of the Court's 9/25/2020 order denying defendants' motion to dismiss, including the claims for injunctive relief (DE #69 ). See Issue # 3. The prior temporal limitations imposed by the Court contemplated plaintiff's claims for injunctive relief, and the Court's subsequent ruling on defendants' motion to dismiss. The Court denies plaintiff's request to adjust the temporal limitations as it relates to discovery notwithstanding the ruling on the prior motion to dismiss. (FTR Log #AT&T Conference Bridge.) The instruction not to answer the question was improper, and the witness is directed to answer the question. The question does not run afoul of the Court's prior order, which limited Plaintiff from seeking information about profits and losses. January 20, 2021 Opinion or Order ORDER: Plaintiff seeks leave #82 to file a motion to compel Defendant Shorefront Operating LLC ("Defendant") to provide answers to certain requests for admission. Defendant's position appears to be that because the requests for admission relate to information outside the period of Leroy Chow's stay at Defendant's facility, it has no obligation to respond. Defendant's position is untenable: Plaintiff is seeking to ascertain whether certain documents--many of which were produced by Defendant--are true and accurate or authentic, requests that are routine and impose little to no cost, burden, or expense. That is, the concerns about limiting the scope of discovery that were attendant to the Court's prior orders--namely burden and proportionality--do not present here, and Defendant's refusal to answer basic or fundamental questions lacks justification. While the Court limited the scope of discovery generally to the period of Chow's residency, Plaintiff is certainly entitled to determine whether information outside that time frame (either information that is publicly available or produced by Defendant) is true and accurate. The motion for leave is denied; Defendant, however, is directed to provide answers to the requests for admission not limited by time frame. The Court is again dismayed by the unnecessary and wasteful motion practice in this case--here, the time and energy expended in refusing to answer requests for admission easily outstrips the time and resources necessary to answer whether documents are true and accurate (and doing so does not prejudice any substantive arguments Defendant may wish to make in opposition to class certification or in support of summary judgment). December 14, 2020 Opinion or Order ORDER: In Plaintiff's motion for leave to amend the Complaint #68 , Plaintiff seeks to amend his Complaint to name two previously unnamed defendants, Bent Philipson and Benjamin Landa. He argues that claims against these parties relate back to the filing of the Complaint under Rule 15(c)(1)(A) under New York's general relation-back statute, CPLR 203. However, under CPLR 1024, "parties are not to resort to the 'Jane Doe' procedure unless they exercise due diligence, prior to the running of the statute of limitations, to identify the defendant by name and, despite such efforts, are unable to do so." Bumpus v. N.Y.C. Transit Auth., 66 A.D.3d 26, 29-30 (2d Dep't 2009). Neither party addresses the applicability of CPLR 1024 or whether those standards have been met. By 12/30/2020, Plaintiff may submit supplemental briefing, limited to three pages, on its efforts, if any, to identify the John Doe Defendants prior to the expiration of the statute of limitations. October 23, 2020 Opinion or Order ORDER: The motion for pre-motion conference #71 is denied. The Court will not permit Defendants to file a motion to strike class allegations. Any motion to strike Plaintiff's class allegations is procedurally improper. A motion to strike is made pursuant to Rule 12(f); under Rule 12(g), "a party that makes a motion under [Rule 12] must not make another motion under this rule raising a defense or objection that was available to the party but omitted from its earlier motion." Defendants filed a Rule 12(b)(6) motion on June 21, 2019. (See Mot. to Dismiss, Dkt. No. 6). Thus, this second Rule 12 motion must be denied. E.g., Cassese v. Wash. Mut., Inc., No. 05-CV-2724, 2007 WL 9723132, at *13 (E.D.N.Y. Sept. 7, 2007) (collecting cases). Separate and apart, any motion to strike class allegations is another attempt to reargue the propriety of class discovery or a premature attempt to resolve class certification. The Court has already concluded that class discovery is appropriate, and indeed admonished Defendants for obstructing class discovery. (Order dated June 5, 2020, Dkt. No. 55, at 1-2 ("Prior to the service of the responses to these RFPs, the Court denied Defendants' motion to trifurcate discovery, which the Court noted was a back-end motion for a stay of discovery. Now,... Defendants ask for a stay of discovery (without filing a cross-motion) or have refused to produce documents. Defendants' responses suggest that they are withholding documents pending decision on the motion to dismiss. Given the Court's prior rulings, the position is frivolous and borderline sanctionable.")). The case is in the middle of discovery, and it would be improper to terminate Plaintiff's ability to complete class discovery and then move for class certification. Defendants request to file such a motion is therefore denied. Travis v. Navient Corp., No. 17-CV-4885, 2020 WL 2523066, at *12 (E.D.N.Y. May 18, 2020) (denying motion to strike class allegations as premature and noting that such a motion would "require[] a reviewing court to preemptively terminate the class aspects of litigation, solely on the basis of what is alleged in the complaint, and before plaintiffs are permitted to complete the discovery to which they would otherwise be entitled on questions relevant to class certification" (quotation omitted)). October 6, 2020 Opinion or Order ORDER: The motion to compel Defendants to unredact documents #66 is granted in part and denied in part. The motion is granted with respect to the Operating Agreement. The Court agrees with Plaintiff that redactions of the Operating Agreement are inappropriate. To the extent that Plaintiffs do not have an unredacted copy of the Operating Agreement, Defendants shall produce one. The Operating Agreement is subject to the Court's so-ordered Confidentiality Agreement. Dkt. No. #32 . The motion is otherwise denied. The Court has reviewed the exemplar documents provided by both sides, as well as Exhibit 1 of Plaintiff's letter motion, which appears to be a redaction log of all documents containing redactions. The redaction log reveals that only 18 documents contain any redacted material. The Court concludes that the scope of redactions--limited as indicated in the log to issues of privilege and financial and profit information that the Court has previously and repeatedly concluded is beyond the scope of discovery--is appropriate. June 11, 2020 Opinion or Order ORDER: Plaintiff has filed a motion to compel asking this Court to enter an ESI protocol. Defendants respond by noting that they are willing to discuss entry of an ESI protocol after reopening following abatement of COVID-19. The motion is denied without prejudice to renewal. The parties are directed to meet and confer about the need for and the parameters of any ESI protocol. Should Plaintiff refile the motion to compel, it must explain why such a protocol is necessary, in light of the production and discovery that has been provided to date. The parties should have discussed an ESI protocol at the outset of the case; to the extent that Defendants were not discussing the protocol with Plaintiff at the time initial disclosures were made, Plaintiff should have moved for relief at that time. An initial conference was held on September 5, 2019. The deadline for completion of Rule 26(a) initial disclosures was August 29, 2019. (Dkt. No. 26). To the extent ESI was an issue or a protocol was necessary it should have been discussed between the parties and appropriate motions should have been filed long ago. See FRCP 26(a)(1)(A)(ii) ("Except as exempted by Rule 26(a)(1)(B) or as otherwise stipulated or ordered by the court, a party must, without awaiting a discovery request, provide to the other parties: a copy--or a description by category and location--of all documents, electronically stored information, and tangible things[.]"); see also FRCP 26(f)(3)(C) ("A discovery plan must state the parties' views and proposals on any issues about disclosure, discovery, or preservation of electronically stored information, including the form or forms in which it should be produced[.]"). Plaintiff has waited nearly 10 months to raise the ESI issue. At this stage of the case, the Court will not require entry of an ESI protocol solely for the sake of entering an ESI protocol -- one will be entered if tailored to the current parameters in the case and if there is some established need for electronic discovery protocols.
