For the reasons stated on the record, the Court construed the parties' pre-motion conference letters as briefing on a motion pursuant to Fed. R. Civ. P. 12(b)(6), and preliminarily ruled that Defendant's motion should be granted. However, because the Court had not given the parties, in particular, Plaintiff, notice that it was going to construe the parties' letters as the motion and response, the Court permitted the parties to file supplemental briefing on this issue. Plaintiff may file a letter of up to five pages by October 7, 2019; and Defendant may file a letter response, also limited to five pages, by October 15, 2019. (Court Reporter Victoria A.
