On July 13, 2020, I denied the defendants' motion for reconsideration #23 and granted the plaintiff until August 27, 2020 to amend his complaint. October 10, 2019 Opinion or Order ORDER: The Court interprets the plaintiff's response in opposition to the defendants' motion to dismiss #7 as a motion to remand the case to state court because the federal court lacks subject matter jurisdiction. The plaintiff's amended complaint alleges claims pursuant to the Fair Credit Billing Act and the Truth in Lending Act, both of which arise under federal law. See 15 U.S.C. 1601, et seq. Because a federal question is presented on the face of the plaintiff's amended complaint, this action is subject to removal pursuant to 28 U.S.C. 1331 and 1441. See Caterpillar Inc. v. Williams , 482 U.S. 386, 392 (1987). Accordingly, the plaintiff's motion to remand the case is dismissed.
