Date Filed Document Text
December 10, 2019 Opinion or Order ORDER: The Court denies Appellant's #4 request that the Court recuse itself from this matter. The mere fact that a party has multiple distinct proceedings before the same judge does not constitute an adequate basis for recusal. See Liteky v. United States, 510 U.S. 540, 555 (1994) ("[O]pinions formed by the judge on the basis of facts introduced or events occurring in the course of the current proceedings, or of prior proceedings, do not constitute a basis for a bias or partiality motion unless they display a deep-seated favoritism or antagonism that would make fair judgment impossible."). Appellant offers no evidence that the Court has formed any "deep-seated favoritism or antagonism" toward Appellant or either of her cases that justifies recusal. Indeed, Appellant's other, non-bankruptcy matter assigned to Court, Bey v. Sup. Ct. of N.Y., No. 19-cv-6704, was only filed on November 19, 2019, and has not proceeded, due to filing deficiencies of which Ms. Bey and the other Plaintiffs have been notified by the Clerk's Office. The Court directs Appellant to file her response to Appellee's motion to dismiss in this matter by 12/17/2019. Appellant is warned that failure to comply with this order may result in the dismissal of this case for failure to prosecute. Ordered by Judge Pamela K. Chen on 12/10/2019. (Shi, Yi Qing)
