October 29, 2019 Opinion or Order Filing 4 MEMORANDUM AND ORDER, granting #2 Motion for Leave to Proceed in forma pauperis. Accordingly, the complaint, filed in forma pauper is dismissed for failure to state a claim. 28 U.S.C. 1915(e)(2)(B). Any state law claims are dismissed without prejudice. In light of Plaintiff's pro se status, however, thecourt grants Plaintiff leave to file an amended complaint within thirty (30) days of the entry of this Memorandum and Order. All proceedings shall be stayed for 30 days. If Plaintiff fails to file an amended complaint within the time allowed or show good cause why he cannot comply, judgment dismissing this action shall be entered. The Clerk of Court is respectfully requested to serve Plaintiff with a copy of this Memorandum and Order and note service on the docket. The court certifies pursuant to 28 U.S.C.-S 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal.
