The former was voluntarily dismissed on 11/21/2019. In the future, counsel must pay attention to identifying the filer of any submission. Ordered by Judge Brian M. Cogan on 11/22/2019. Filing 4 In accordance with Rule 73 of the Federal Rules of Civil Procedure and Local Rule 73.1, the parties are notified that if all parties consent a United States magistrate judge of this court is available to conduct all proceedings in this civil action including a (jury or nonjury) trial and to order the entry of a final judgment. Attached to the Notice is a blank copy of the consent form that should be filled out, signed and filed electronically only if all parties wish to consent. The form may also be accessed at the following link: #http://www.uscourts.gov/uscourts/FormsAndFees/Forms/AO085.pdf. You may withhold your consent without adverse substantive consequences. Do NOT return or file the consent unless all parties have signed the consent. (Bowens, Priscilla) |
ORDER granting #2 . Plaintiff's motion to proceed anonymously is granted subject to further review by the Court at subsequent stages of the litigation, if necessary. The Court finds that the nature of the allegations in this case, plaintiff's credible fear of retaliation from non-parties, and the risk of chilling litigation by a victim of sex trafficking all caution in favor of protecting plaintiff's identity. Furthermore, because plaintiff is willing to provide the relevant personal information to defendants under a protective order, defendants will not suffer the prejudice of having to defend against allegations by an unknown person. Finally, allowing plaintiff to proceed under a pseudonym will not meaningfully offend the public's interest in access to judicial proceedings, as all other aspects of the record will remain public. The Court will reconsider this Order de novo if defendants or an interested party objects within 14 days. Plaintiff is directed to serve a copy of this Order on defendants and their known attorneys immediately. In the meantime, plaintiff may use the pseudonym in the caption in all public court filings, but shall submit a sealed filing revealing her name to the Court. Ordered by Judge Brian M. Cogan on 10/30/2019. (Weisberg, Peggy) |
