November 14, 2019 Opinion or Order Filing 4 MEMORANDUM and ORDER: Plaintiff's request to proceed in forma pauperis #2 is granted. The Complaint fails to state a claim for discrimination or retaliation under Title I of the ADA or the FMLA. In light of Plaintiff's pro se status, the Court grants 30 days leave to amend the Complaint in order to state a claim under these provisions. Plaintiff is reminded that an amended complaint completely replaces the original complaint. The amended complaint must be captioned, "Amended Complaint," and shall bear the same docket number as this order. No summons shall issue at this time, and all further proceedings shall be stayed for 30 days. If Plaintiff fails to file an amended complaint within 30 days, the Complaint will be dismissed for failure to state a claim pursuant to 28 U.S.C. 1915(e)(2)(B). The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). SO Ordered by Judge William F. Kuntz, II on 11/13/2019. (Tavarez, Jennifer)
