Filing 5 MEMORANDUM AND ORDER DISMISSING CASE, For the reasons that follow, the Complaint is dismissed for lack of subject matter jurisdiction and as frivolous. The Complaint fails to assert a valid basis for this court's jurisdiction and is frivolous. Accordingly, the Complaint is dismissed pursuant to Fed. R. Civ. P. 12(h)(3) and pursuant to the court's "inherent authority" to dismiss frivolous actions. Fitzgerald, 221 F.Sd at 364. The court has considered affordingplaintiff a chance to amend the Complaint, but a review of the Complaint does not suggest that plaintiff has inadequately or in artfully pleaded any potentially viable claims that could be improved by amendment. Although plaintiff paid the filing fee to commence this action, the Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of anyappeal. Coppedge v. United States, 369 U.S. 438, 444-45 (1962).
