December 23, 2019 Opinion or Order ORDER: The Court notes that, prior to going on the record at the December 23, 2019 TRO argument, Plaintiff's counsel represented to the Court that he had communicated with counsel for Defendant Shenzhen Trynow Intellectual Property Co., Ltd. (TryNow), who represented that that Trynow did not wish to appear at the hearing, either in person or via phone call. For that reason and because, as noted on the record at the hearing, Defendant Wen has not appeared in this matter (despite Plaintiff having emailed a copy of the complaint and motion papers), the Court proceeded ex parte. However, the Court did consider and reference on the record Exhibit A to Dkt. #10 , i.e., the letter from Haoyi Chen, Counsel for TryNow, who wrote that TryNow does not object to Plaintiff's Proposed Order, provided that a 21-day extension for a response is granted.
