February 25, 2020 Opinion or Order ORDER: Petitioner Sterling is directed to respond to Respondent's #7 Motion to Dismiss by March 24, 2020. In his response, Petitioner should address whether he has made efforts to exhaust his claim of ineffective assistance of counsel, including whether he has filed a 440.10 motion. Should Petitioner wish to amend his Petition, and assert his claims with additional particularity, he may do so by the same deadline. Should Plaintiff elect to file an amended petition, it shall be captioned "AMENDED PETITION" and bear the same docket number as this Order: 1:20-CV-00283 (PKC) (LB). Plaintiff must provide facts to support his claims -- the amended petition shall replace the original. That is, the amended petition must stand on its own without reference to the original petition.
