November 25, 2020 Opinion or Order Filing 14 DECISION & ORDER: Plaintiffs Marcelo Valenzuela and Liseth Teran (collectively, "Plaintiffs") filed a Complaint in the Supreme Court of New York, County of Queens against defendants Western Express of New York, New Horizons Leasing Inc., and Tyrone Barron (collectively, "Defendants") seeking, inter alia, damages for personal injuries and loss of consortium. Compl., ECF No. #1 - #1 . Defendant removed the action to this Court on the basis of diversity of citizenship jurisdiction. Notice of Removal 3-9, ECF No. #1 . On July 16, 2020, Plaintiff filed a motion to remand the action to state court for untimeliness of the motion. Pls. Mot. to Remand at 2-4, ECF No. #11 . Defendant opposes remand. Decl. of Keith A. Raven in Opp'n 2, ECF No. #13 ("Def. Opp."). For the reasons stated above, Plaintiff's motion to remand, ECF No. #11 , is GRANTED. The Clerk of Court is respectfully directed to remand this action to the New York Supreme Court, Queens County and close this case. So Ordered by Judge William F. Kuntz, II on 11/25/2020. March 31, 2020 Opinion or Order Filing 7 ORDER: In light of the COVID-19 outbreak and the 30-day extension of the Coronavirus Guidelines for America ordered by the President of the United States on March 29, 2020, the Court hereby adjourns the pre-motion conference currently scheduled for April 15, 2020 as moot and orders the following briefing schedule regarding Plaintiffs' motion to remand and motion for attorneys' fees: Plaintiffs will submit a motion and briefing on all related issues no later than Friday, May 8, 2020 by 5:00 P.M.; Defendants will respond no later than Friday, June 19, 2020 by 5:00 P.M.; Plaintiffs will reply no later than Friday, July 17, 2020 by 5:00 P.M. As a courtesy to the Court, the Court requests the parties refrain from filing motion papers until the motion has been fully briefed. If the parties elect to file their motion only once it is fully briefed, the notice of motion and all supporting papers are to be served on the other party along with a cover letter setting forth whom the movant represents and the papers being served. Only a copy of the cover letter shall be electronically filed in advance of the fully briefed motion, and it must be filed as a letter, not as a motion. On the day the motion is fully briefed, each party shall electronically file their individual motion papers by 5:00 P.M. on July 17, 2020.
