Filing 5 ORDER: The Court grants Plaintiff's request to proceed in forma pauperis pursuant to 28 U.S.C. 1915(a). The complaint, filed in forma pauperis, is dismissed for failure to state a claim. 28 U.S.C. 1915(e)(2)(B). However, in light of Plaintiff's pro se status, the Court grants Plaintiff leave to file an amended complaint within 30 days if she can, in good faith, establish the Court's subject matter jurisdiction over this matter and state a claim on which relief may be granted. If Plaintiff fails to file an amended complaint within the time allowed or show good cause as to why she cannot comply with the 30-day deadline, judgment dismissing this action shall be entered. SEE ATTACHED ORDER. Ordered by Judge Eric R. Komitee on 3/25/2020. c/m to plaintiff. (Guy, Alicia) |
ORDER denying #4 Motion to Stay -- No defendant has yet appeared in response to the complaint, there has been no trial, and this court has not entered any judgment in this case that could be stayed. As a result, there is no basis for the requested relief, which I in any event would lack authority as a magistrate judge to grant. I therefore deny the motion. Ordered by Magistrate Judge James Orenstein on 3/10/2020. (Walker, Anna) |
Filing 4 Letter MOTION to Stay by Sylvia C. Simmons. (Ramesar, Thameera) |
