April 27, 2020 Filing 6 Consent MOTION to Adjourn Conference by Jaimie L. Derisi. (Lauriello, Valerie)
April 27, 2020 Opinion or Order ORDER denying #6 Motion to Adjourn Conference. Plaintiff has failed to file proof of service on defendant as required by Federal Rule of Civil Procedure 4(l), and this Court does not extend defendants' time to answer where a defendant has failed to appear. In addition, it is up to the Court, not plaintiff's counsel, to determine whether a defendant's time to answer should be extended, and a general reference to the pandemic is insufficient to warrant a 60 day extension of time to answer in any event. Finally, plaintiff's letter refers to a consent to reassign the case to a Magistrate Judge, but no such consent has been filed and so the case cannot be reassigned. Ordered by Judge Brian M. Cogan on 4/27/2020. (Weisberg, Peggy)
