MEMORANDUM AND ORDER: This case is remanded to the Supreme Court of the State of New York, County of Kings. The Clerk of Court is directed to send a certified copy of this Order to the Clerk of Supreme Court, County of Kings and to close this case in this Court. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal from this order in forma pauperis would not be taken ingood faith and therefore in forma pauperis status is denied for the purpose of an appeal.
