Filing 4 MEMORANDUM in Support of Order to Show Cause for Removal filed by Modern Facilities Services, Inc., Port Authority of New York & New Jersey. (Attachments: #1 Proposed Order, #2 Exhibit A, #3 Exhibit B) (Kim, Alexander) |
Order of Remand to Supreme Court, Queens County, case number 715869/2019, on the ground that this case was not timely removed. First, the removal period begins to run when the defendant gets notice of the amount in controversy, not when the defendant's substitute counsel gets notice. Therefore, it does not matter if former counsel did not give the notice of amount in controversy to current counsel. In addition, the record shows that current counsel did receive notice of the amount in controversy in March, 2020. Petition Ex. F, #11. Counsel's response to this Court's Order to Show Cause is frivolous. Ordered by Judge Brian M. Cogan on 6/16/2020. (Cogan, Brian) |
ORDER TO SHOW CAUSE. Defendants are ORDERED TO SHOW CAUSE by 6/17/2020 why this action should not be remanded to state court as untimely removed. Ordered by Judge Brian M. Cogan on 6/10/2020. (Weisberg, Peggy) |
