ORDER: Mark Inesti ("Petitioner"), currently incarcerated at Clinton Correctional Facility, brings this pro se petition for a writ of habeas corpus pursuant to 28 U.S.C. 2254 challenging the constitutionality of his 1996 conviction in the New York Supreme Court, Kings County. Pet. at 1. Petitioner paid the required filing fee. The instant petition is a duplicate of a section 2254 action Petitioner previously filed in this court, which was dismissed on July 20, 2020. Inesti v. People of the State of N.Y., 20-CV-1753, ECF No. 9 (E.D.N.Y.) (Kuntz, J.). Accordingly, the instant petition is dismissed for the same reasons discussed in Petitioner's prior action. The clerk of court is respectfully directed to close this case. A certificate of appealability shall not issue. See 28 U.S.C. 2253(c)(2). So Ordered by Judge William F. Kuntz, II on 7/31/2020.
