In light of the cover letter, it is unclear whether Petitioner intended to file his motion ex parte or under seal. Regardless, all parties to this matter are directed to file a motion asking whether they can file a document under seal prior to doing so. The Clerk of Court is respectfully directed to unseal [50-1] the Court transcript attached to Petitioner's motion. Respondent will be permitted to proceed with her retained expert first as she is ready to proceed, the parties are operating within an expedited timeframe, and Respondent carries the burden of proof for an affirmative defense.
