ORDER granting in part #10 . The reasons offered for this requested adjournment are not persuasive. First, this Court uses the joint summary letter as the take off point for the case, not the answer, because "[i]n truth, the answer in a civil action is the most useless paper in the courthouse." Alexander By and Through Alexander v. Richardson-Merrell Inc., 541 F.Supp. 93, 94 (S.D.N.Y. 1982). Second, the possibility that the EEOC will subsequently deny plaintiff's administrative claim will have no impact on discovery, even if plaintiff feels compelled to amend her complaint (for which there would seem to be no reason). Third, if the 21 days under Rule 26 doesn't work, the Court hereby waives that period and the parties are ordered to meet in less time than that. The conference is converted to a telephone conference and is adjourned only to 9/29/2020 at 12:30 pm which is plenty of time for defendant to assess its defenses to the case. Parties are directed to use the toll-free number 888-684-8852 and access code 6427877# and are reminded to comply with the mandatory requirements set forth at #5 and shall file on the docket a completed case management prior to the conference. The parties are advised that this case appears to the Court to be a straightforward FMLA that is going to move a lot faster than the parties apparently think it is. Ordered by Judge Brian M.
