September 23, 2020 Opinion or Order ORDER granting in part #6 . Defendant City of New York's time to answer is extended to 12/4/2020. However, the Court does not sua sponte grant extensions of time to defendants who have not appeared. Nor does this Court wait for answers to be filed before the Initial Status Conference as they are not of any use in planning discovery. ACC Bonillas (who may be new, as the ACCs with whom this Court has regularly dealt with over the last 14 years are well aware of the Court's procedures in 1983 actions) is expected to contact one or more of the officers involved and get their story for the joint summary letter that is required for the conference, not to provide this Court with a form letter. In addition, there is something wrong with the ACC's statement that "Although a 160.50 release for sealed records has been forwarded to plaintiff for execution, this form has not yet been received." Mr. Klein is well aware of this Court's requirement, as set forth in its scheduling order, that he should have already served the 160.50 release on the City together with the summons and complaint. One of the attorneys is therefore going to have some explaining to do at the conference if they have contributed to delaying this action.The conference is adjourned to 10/29/2020 at 11:45 am and shall proceed as a telephone conference. The parties are directed to use the toll-free number 888-684-8852 and access code 6427877# and are reminded to comply with the mandatory requirements set forth at #5 , including filing on the docket a completed case management prior to the conference.
