October 22, 2020 Opinion or Order Filing 5 TRANSFER ORDER: Plaintiff Eric Jackson ("Plaintiff'), currently being detained at Fishkill Correctional Facility, brings this pro se action in relation to his request to be paroled from that facility. Since Plaintiff's claims relate to events alleged to have occurred in Dutchess County, New York, this Court is not the appropriate court in which to file this action. A district court may transfer an action filed in the wrong district court, "to any district... in which it could have been brought," 28 U.S.C. 1406(a), "[f]or the convenience of parties and witnesses, [and] in the interest of justice." 28 U.S.C. 1404(a). Accordingly, in the interest of justice, the Clerk of Court is hereby directed to transfer this action to the United States District Court for the Southern District of New York. 28 U.S.C. 112(b), 1406(a). The Court offers no opinion on the merits of the action. The decision on Plaintiff's application to proceed in forma pauperis pursuant to 28 U.S.C. 1915 and enforcement of the Prison Litigation Reform Act is reserved for the transferee court. The provision of Local Rule 83.1 which requires a seven-day stay is hereby waived. Summonses shall not issue from this Court and the Clerk of Court is respectfully directed to mark this case closed. Case transferred to the United States District Court for the Southern District of New York. Original file, certified copy of transfer order, and docket sheet sent.
