Because Defendant intends to challenge the New York Child Victim Act as unconstitutional under the New York constitution, the court will hold Defendant's time to answer the complaint, and any briefing schedule for the intended motion to dismiss, in abeyance until Defendant complies with Federal Rule of Civil Procedure 5.1. Under Rule 5.1, the New York Attorney General will have 60 days from the service of notice to intervene on the question of the state statute's constitutionality. After such time has passed, the parties may propose a mutually-agreeable briefing schedule. The court will separately issue the certification required under 28 U.S.C. 2403(b).
