ORDER denying as unnecessary #8 . The ACC did not read this Court's Order carefully. The Order said that the Court "will set an answer date at the conference if it has been inconvenient for the City to answer prior to the conference." The conference has been reset to 1/12/2021. That means the City does not have to answer before 1/12/2021 unless it wants to, and if it doesn't, the Court will set a new date at the conference. Ordered by Judge Brian M. Cogan on 12/2/2020. ORDER granting in part #7 . The Court has previously advised many ACCs to stop sending the City's form letter that requests an adjournment of the Initial Status Conference until issue is joined and for a sua sponte extension to answer for the individual defendant. The Court does not grant the first request because the boilerplate answer is of little to no use in planning discovery so there is no reason to wait. It does not grant the second request because the individual defendant is obligated to answer in accordance with the Federal Rule of Civil Procedure, and since the City isn't going to act as his counsel, the Court isn't either. Notwithstanding the above, the Initial Status Conference is adjourned to 1/12/2021 at 12:30 p.m. That will have given the City two months since it was served, plenty of time to talk to the police officer involved, submit the Joint Summary Letter and Case Management Plan required by this Court's scheduling order, and fully participate in the conference. The Court will set an answer date at the conference if it has been inconvenient for the City to answer prior to the conference. The conference will be held by telephone.
