January 29, 2021 Opinion or Order ORDER: In their pleadings, plaintiffs seek the following equitable relief: declaratory judgment that Executive Order 202.81 which compels the shutdown of indoor dining in New York City to be unlawful and an order enjoining Defendants and their agents, officers, servants and employees from enforcing Executive Order 202.81. Dkt. 1 at 1819. Similarly, the preliminary injunction sought by plaintiffs would enjoin Defendants, from enforcing Executive 202.81 and allow[] NYC Indoor Dining to resume to pre-December 14, 2020 state issued guidance. Dkt. 5 at 2. The Court understands from media accounts written today, January 29, 2021, that Governor Cuomo intends to permit indoor dining to resume in New York City restaurants at 25% capacity beginning on February 14, 2021. See https://www.nytimes.com/2021/01/29/nyregion/indoor-dining-nyc-restaurants.html. Accordingly, in addition to the currently scheduled briefing, plaintiffs and the state are each directed to file, on or before February 5, 2021, separate, supplemental memoranda addressing what impact, if any, the governors contemplated order has on plaintiffs pending application for relief.
