May 20, 2021 Opinion or Order SCHEDULING ORDER: The parties' joint request #23 to amend the Court's May 5, 2021 scheduling order is GRANTED in part and DENIED in part. The evidentiary hearing shall commence on July 19, 2021 at 10:30 a.m. Fact discovery shall be completed by June 7, 2021. Expert discovery shall be completed by June 23, 2021. Each party shall file their pre-trial memorandum, detailing their arguments, by June 21, 2021. Responses to pre-trial memoranda shall be filed by July 1, 2021. Any motions in limine shall be filed by June 28, 2021, except that motions in limine relating to experts or rebuttal experts shall be filed by July 1, 2021. The Court extends the deadline for Respondent to answer or move to dismiss the petition to May 10, 2021, but encourages Respondent to file an answer as, based on a review of the petition, a motion to dismiss is unlikely to succeed. April 16, 2021 Opinion or Order ORDER: On April 8, 2021, the United States Marshals Service ("USMS") attempted to serve process on Respondent. She expressly refused service, and indicated that she did not have any passports for the minor children. (See ECF No. 11-2.) On April 13, 2021, Petitioner filed a motion for alternate service as follows: (A) for the USMS to affix the order rescheduling the Show Cause Hearing, all previously entered orders, and all pleadings and papers on the door of Respondent's dwelling place located at: 536 4th St., Brooklyn, NY 11215 and to thereafter file proof of service; (B) for Petitioner's counsel to mail all previously entered orders, and all pleadings and papers to Respondent's dwelling place located at: 536 4th St., Brooklyn, NY 11215 and to send the same process to her again by email to: kristintonnesen@yahoo.com; and (C) for Petitioner's counsel to thereafter file proof of service; and (D) that service be considered complete upon the filing of the USMS proof of service and Petitioner's counsels proof of service. Rule 4(e) of the Federal Rules of Civil Procedure provides that an individual may be served by "following state law for serving a summons in an action brought in courts of general jurisdiction in the state where the district court is located or where service is made." Fed. R. Civ. P. 4(e). Under New York law, if service by other means cannot be made "with due diligence," service may be made by affixing the summons to the door to the "usual place of abode" of the individual and "by mailing the summons to such person at his or her last known residence." N.Y. C.P.L.R. 308(4). And, if that is not practicable, service may be executed "in such manner as the court, upon motion without notice, directs." Id. 308(5). Having found that service was previously attempted with due diligence, that service pursuant to N.Y. C.P.L.R. 308(4) will likely not be practicable, and in light of the need for the Court to expeditiously resolve this issue pursuant to the directives of the Hague Convention, Petitioner's request #11 for alternative service is GRANTED. An Order to Show Case hearing shall be held on April 23, 2021 at 1:00 p.m. The public is directed to use the following conference line and dial-in information: 1-650-479-3207; access code 160 106 0584.
