Date Filed Document Text
May 20, 2021 Filing 5 Amended MOTION for Leave to Proceed in forma pauperis by Lauretta Humphrey. (Herrera, Isaiah)
May 7, 2021 Opinion or Order Filing 4 ORDER denying #2 motion for leave to proceed in forma pauperis. For the reasons set out in the attached order, plaintiff's application for IFP status is denied without prejudice to renewal. If plaintiff wishes to proceed without the prepayment of fees, she must submit an amended application that establishes that she qualifies to proceed IFP within 30 days. If plaintiff is unable to demonstrate indigency, plaintiff must pay the $402 filing fee to the Clerk of Court of the Eastern District of New York within 30 days of the date of this order to proceed with her case. If plaintiff does not submit another IFP application or remit the filing fee within 30 days, this action will be dismissed without prejudice. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal would not be taken in good faith and therefore IFP status is denied for the purpose of any appeal. Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Clerk of Court is respectfully directed to mail a copy of this order and the attached memorandum to plaintiff. Ordered by Judge Rachel P. Kovner on 5/7/2021. (Kahwash, Sarah)
