July 15, 2021 Opinion or Order Minute Entry and Order: A telephonic Initial Conference and Pre-motion Conference was held on 7/15/2021 before Magistrate Judge Taryn A. Merkl. Appearances by Randy Kleinman for the plaintiff and Eric Leibowitz for the defendants. As stated on the record, the parties are prepared to discuss the retention of defendant Arch Insurance Company (AIC) as a defendant in this matter, and will advise the court in two weeks as to whether defendant AIC intends to file a pre-answer motion to dismiss. The parties are directed to file a joint status report with the court by 7/29/2021 indicating whether defendant AIC will proceed by motion. If a motion is necessary, the parties are respectfully directed to include a mutually agreed-upon proposed briefing schedule in the status report. In addition, the parties represented that Rule 26 initial disclosures have been exchanged. The parties' discovery plan is adopted, in part, as follows. The parties shall exchange their first requests for production of documents and interrogatories by 8/14/2021, with Phase I discovery to be completed by 9/13/2021. The deadline for joining additional parties and amending the pleadings is 10/12/2021. Fact discovery shall be completed on or before 11/26/2021, and the parties shall file a certification on ECF of the close of fact discovery on or before 12/3/2021. Expert witness reports shall be exchanged by 12/27/2021. All discovery shall be completed by 2/11/2022, and the parties shall file a certification on ECF of the close of all discovery on or before 2/18/2021. The last date to take the first step in dispositive motion practice is 3/11/2022, and should be done in accordance with Judge Eric Komitees Individual Rules and Practices. A telephonic Status Conference will take place on 9/29/2021 at 2:15 p.m. before Magistrate Judge Taryn A. Merkl. The parties are directed to call the toll-free number (877) 336-1839.
