Filing 7 CLERK'S JUDGMENT that the complaint is dismissed for failure to state a claim pursuant to 28 U.S.C. 1915(e)(2)(B); 1915A, in its entirety; that pursuant to 28 U.S.C. 1915(a)(3), any appeal would not be taken in good faith; and that in forma pauperis status is denied for the purpose of any appeal, Coppedge v. United States, 369 U.S. 438, 444-45 (1962). Ordered by Jalitza Poveda, Deputy Clerk on behalf of Douglas C. Palmer, Clerk of Court on 8/19/2021. (Copy of Judgment and Appeals Packet mailed to Pro Se). (Herrera, Isaiah) |
Filing 6 ORDER DISMISSING CASE: For the foregoing reasons, the complaint, filed in forma pauperis, is dismissed for failure to state a claim pursuant to 28 U.S.C. 1915(e)(2)(B); 1915A, in its entirety as set forth above. Although pro se plaintiffs are ordinarily accord leave to amend the complaint at least once, in cases like this, where it is clear that any attempt to amend would be futile, leave to amend need not be given, and for that reason it is denied here. The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of any appeal. See Coppedge v. United States, 369 U.S. 438, 44445 (1962). The Clerk of Court is directed to enter judgment accordingly, to mail a copy of this memorandum and order to plaintiff, and to close this case. So Ordered by Judge Eric N. Vitaliano on 7/26/2021. (Herrera, Isaiah) |
