July 30, 2021 Opinion or Order Filing 3 SCHEDULING ORDER. The plaintiff, pro se, is granted leave to proceed in forma pauperis. The Clerk of Court is directed to forward copies of the plaintiffs Complaint and this Order to the United States Marshal for the Eastern District of New York for service on the Commissioner, without prepayment of fees. The Commissioner will proceed promptly to obtain the administrative record of the proceedings below, and will file the record by October 25, 2021. The Commissioner will file and serve a motion for judgment on the pleadings, which must contain a full recitation of the relevant facts and administrative record, by December 27, 2021; the plaintiff will file and serve a response to the Commissioners motion, and any cross-motion, by February 25, 2022; and the Commissioner will file and serve its reply, if any, by March 18, 2022. The parties are to comply in all respects with applicable Local Rules for this district and this Courts Individual Practices and Rules, including but not limited to the Courts Individual Practice and Rules 1(D) and 4(C) regarding proper courtesy copy procedure and legal memoranda page limitations (i.e., 25 pages for opening and opposition briefs, and 10 pages for reply briefs).
