ORDER re: #11 . Neither side's contribution to this letter is sufficient. Plaintiff's portion of the letter does not disclose the people who were responsible for rejecting plaintiff's request for accommodation. Saying that NYCHSS "and/or" its director did it is not adequate. The Court needs to know what happened here. Who is the point person with whom plaintiff was dealing? Defendants' portion of this letter is no better. The Court appreciates that defense counsel is new to the case - although his client was served a month ago - but nothing is preventing him from calling the key person reflected in plaintiff's personnel file, talking to at least one person who knows what happened, and submitting that story on a without prejudice basis. The parties are directed to file a supplemental letter curing this non-compliance by 10/6/2021 at 12 noon. Ordered by Judge Brian M. Cogan on 10/1/2021. (Weisberg, Peggy) |
Filing 10 SUMMONS Returned Executed by John Hammel. Annalisa Williams served on 9/25/2021, answer due 10/18/2021. (Phillips, William) |
ORDER denying #9 Motion to Adjourn Conference. The parties are reminded of the mandatory requirements previously posted, which is binding on all parties, answer or not. Ordered by Judge Brian M. Cogan on 9/17/2021. (Weisberg, Peggy) |
