November 3, 2021 Opinion or Order Filing 5 ORDER: For the reasons stated in the attached Memorandum and Order, the Court dismisses the complaint. The #4 Order to Show Cause dated October 12, 2021 is hereby vacated. Because the petition makes no substantial showing of a denial of a constitutional right, a certificate of appealability will not issue. See 28 U.S.C. 2253(c)(2). Although Petitioner paid the filing fee to commence this action, the Court certifies under 28 U.S.C. 1915(a)(3) that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Clerk of Court is respectfully directed to enter judgment and terminate this case. Ordered by Judge Pamela K. Chen on 11/3/2021.
