November 12, 2021 Opinion or Order Order re #9 : The Court is in receipt of Attorney Samson Freundlich's purported Notice of Appearance filed pursuant to this Court's 11/09/2021 Minute Entry and Order. However, the Notice of Appearance has been improperly docketed as "Notice of Appearance by Paul Ajlouny on behalf of All Plaintiffs" and the ECF filer is identified as "Ajlouny, Paul," suggesting that Mr. Freundlich used attorney Paul Ajlouny's ECF credentials to file the Notice of Appearance. As of today, Mr. Freundlich still is not listed as counsel of record in this case. Accordingly, by 11/17/2021, Mr. Freundlich shall register for his own ECF credentials, refile his notice of appearance using his own credentials, and ensure that he receives electronic notification of activity in this case. November 9, 2021 Opinion or Order Filing 10 MINUTE ENTRY AND ORDER: A telephonic initial conference was held on 11/09/2021 before Magistrate Judge Marcia M. Henry. Samson Freundlich (unnoticed), counsel for Plaintiff, and Michael Zimmerman, counsel for Defendants, were present. As stated on the record, Mr. Freundlich is directed to file a notice of appearance by 11/09/2021 at 5:00 p.m. Defendants shall file a letter of less than three (3) pages by 11/22/2021 clearly stating the basis for removal from state court, including specific dates regarding the Defendants knowledge of the amount in controversy, see 28 U.S.C. 1332 and 1446(c). With respect to discovery, the proposed scheduling order at #8 is so ordered, except that: (1) in B.4, the proposed date for a settlement conference before the undersigned is "TBD" and may be revisited after the parties participate in the EDNY Mediation Program; (2) in C.3, the parties shall serve initial interrogatories and document demands by 12/01/2021 (not 12/01/2022); (3) in C.4 and C.5, fact discovery shall be completed by 04/20/2022, with the parties filing a status report the same day certifying that fact discovery is completed; and (4) in C.7 and C.8, all discovery shall be completed by 10/05/2022, with the parties filing a status report the same day certifying that all discovery is completed. The parties shall file a joint status report of no longer than three (3) pages by 01/10/2022 regarding progress on discovery, including any disputes, and settlement discussions, if any.
