Order re #10 : Defendant Mercedes-Benz Financial Services USA LLC ("Mercedes-Benz") was served with the summons and complaint on 11/04/2021; the deadline to answer or otherwise respond to the complaint was 11/24/2021. (ECF No. #5 .) On 12/22/2021, after the deadline to answer had lapsed, Plaintiff and Defendant Mercedes-Benz jointly moved for an extension of time for Defendant Mercedes to file its answer and counsel for Defendant Mercedes purported to enter a notice of appearance. (ECF No. #10 .) Accordingly, by 01/04/2022, Defendant Mercedes-Benz shall file a letter (not to exceed three pages) that explains why, under the standards set forth in Enron Oil Corp. v. Diakuhara, 10 F.3d 90, 96 (2d Cir. 1993), a belated answer is permissible, and why a default should not be entered. Liang v. Home Reno Concepts, LLC, 803 F. App'x 444, 446 n.2 (2d Cir. 2020). Further, on or before 12/28/2021, counsel for Defendant Mercedes-Benz shall file a separate notice of appearance using the appropriate "Notice of Appearance" event in the relevant ECF menu.
