January 11, 2022 Opinion or Order ORDER DISMISSING CASE -- Plaintiff's #2 Motion for Leave to Proceed in forma pauperis is granted. In the #1 Complaint, Plaintiff sets forth his "Statement of Claim" as follows: "The FBI drug me up and they put a chip & tracker without me knowing. All the FBI agent did he destroyed my life. They did insurance fraud surgery and they chopped up my organs." See Complaint at 5, ECF No. 1. Pursuant to 28 U.S.C. 1915(e)(2)(B), this action is DISMISSED as frivolous, without prejudice. See Neitzke v. Williams, 490 U.S. 319, 325 (1989) (noting that "a complaint... is frivolous where it lacks an arguable basis either in law or in fact"); see also Gallop v. Cheney, 642 F.3d 364, 368 (2d Cir. 2011) ("A court may dismiss a claim as factually frivolous if the sufficiently well-pleaded facts are clearly baselessthat is, if they are fanciful, fantastic, or delusional." (quotation marks omitted)); Fitzgerald v. First E. Seventh St. Tenants Corp., 221 F.3d 362, 364 (2d Cir. 2000) (noting that "district courts may dismiss a frivolous complaint sua sponte"). The Court certifies pursuant to 28 U.S.C. 1915(a)(3) that any appeal from this Order would not be taken in good faith, and, therefore, denies in forma pauperis status for purposes of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). So Ordered by Judge Diane Gujarati on 1/11/2022. (Almonte, Kelly)
