ORDER granting #2 Motion for Leave to Proceed in forma pauperis. Petitioner filed a motion to proceed in forma pauperis on December 28, 2021. Upon review of petitioner's in forma pauperis application, the Court finds that petitioner's financial status qualifies him to commence this action without prepayment of the filling fee. Accordingly, petitioner's application to proceed in forma pauperis is granted, and petitioner is granted leave to proceed without being required to prepay fees or costs, or give security therefor. The Clerk of Court is respectfully directed to send a copy of this Order to the pro se petitioner.Respondent shall file a complete and entire answer or other pleading in response to #1 the petition for a writ of habeas corpus, and shall electronically file the State Court Record, within sixty (60) days of the date of this Order. Petitioner shall file any reply to Respondent's answer within thirty (30) days of the filing of Respondent's answer. The Clerk of Court shall electronically serve copies of this Order and the petition upon the Attorney General of the State of New York and the District Attorney for Kings County, and note service on the docket.
