Filing 8 ORDER: Pro se plaintiff Prasad Chalasani requests pro bono counsel. ECF No. #7 . Although the Court would prefer all parties to have access to counsel, there is no right to counsel in a civil case. Guggenheim Capital, LLC v. Birnbaum, 722 F.3d 444, 453 (2d Cir. 2013). The Court cannot compel an attorney to represent a litigant in a civil case without a fee. Mallard v. U.S. Dist. Court, 490 U.S. 296 (1989). Accordingly, plaintiff's request for pro bono counsel is denied without prejudice.Although he states he contacted the Pro Se Legal Assistance Project without success, that office provides free, limited-scope legal assistance to litigants appearing before this Court. While they will not represent plaintiff for all purposes, they will consult and advise him regarding his case. He should contact them again. A copy of the City Bar Justice Centers flyer is included with this Order. See attached Order. Ordered by Magistrate Judge Lois Bloom on 3/1/2022. (Yindra, Hannah) |

Accordingly, if proper service is not made upon defendants by May 12, 2022, or if plaintiff fails to show good cause why such service has not been effected by that date, I shall recommend that the case should be dismissed without prejudice.
