ORDER: The Court grants the #15 Motion to Vacate the Scheduling Order issued on 8/15/2022. All deadlines in this case are adjourned sine die until there is a ruling on the motion to consolidate in Artery v. Astra Space, Inc., et al., No. 22-cv-00737. ORDER: Pursuant to 15 U.S.C. 78u-4(a)(3)(A), Plaintiff Christine E. Riley had 20 days after the filing of the #1 Complaint to "publish[], in a widely circulated national business oriented-publication or wire service, a notice advising members of the purported plaintiff class" of this action and that any member of the purported class had 60 days thereafter to move this Court to serve as lead plaintiff. By 8/19/2022, Plaintiff Riley is hereby ordered to file on ECF proof of such publication within 20 days of the date the Complaint was filed. Further, the Court notes that on 5/10/2022, attorney Tamar A. Weinreb filed a notice of appearance on behalf of "Lead Plaintiff Movant Qingping Deng and Plaintiff Christine E. Riley." (See Dkt. #13 .) Yet neither Qingping Deng nor Christine Riley have yet moved to be appointed lead plaintiff. In accordance with 15 U.S.C. 78u-4(a)(3), the Court hereby orders that any member of the purported class for this action requesting to be appointed lead plaintiff file a motion for appointment of lead plaintiff by 9/15/2022. ORDER. For the reasons stated in the letter at #14 , discovery is stayed and the upcoming Telephonic Initial Conference scheduled for 8/16/2022 is adjourned sine die. Counsel are reminded that should they identify a scheduling concern, they should promptly contact the Court. The letter at #14 does not provide any explanation as to why counsel waited until two weeks before the upcoming conference to raise an issue based on a stipulation submitted and signed four months ago, after the Scheduling Order at #5 was entered.
