The Court is in receipt of Defendant's [17-1] Offer of Judgment, Plaintiff's #17 Notice of Acceptance of Defendant's Offer of Judgment, and the parties' #18 Motion for Settlement under Federal Rule of Civil Procedure 68(a) in the amount of Sixty Thousand Dollars and Zero Cents ($60,000.00). The Court is concerned that the parties' Rule 68(a) settlement is an attempt to evade judicial scrutiny under Cheeks v. Freeport Pancake House, Inc., 796 F.3d 199 (2d Cir. 2015), which requires judicial review of private settlements in FLSA cases to ensure they are fair and reasonable. Nevertheless, given the Second Circuit's decision in Mei Xing Yu v. Hasaki Rest., Inc., 944 F.3d 395, 411 (2d Cir. 2019), holding that judicial approval is not required for Rule 68(a) offers of judgment settling FLSA claims, the Court is compelled to accept the parties' settlement.
