ORDER denying #2 Motion for TRO -- This matter has been referred to me by Judge LaShann DeArcy Hall, in my capacity as the judge on miscellaneous duty. Plaintiff's emergency motion for a temporary restraining order or, in the alternative, a stay of removal #2 , is DENIED. The jurisdiction-stripping provision of the REAL ID Act of 2009, codified at 8 U.S.C. 1252(g), states that "no court shall have jurisdiction to hear any cause or claim by... any alien arising from the decision or action by the Attorney General to commence proceedings, adjudicate cases, or execute removal orders against any alien under this chapter." See also Shahid v. Holder, No. 09-CV-6094, 2009 WL 2046040, at *2 (S.D.N.Y. July 15, 2009) (denying a writ of habeas corpus and emergency stay of removal as "explicitly barred by the Real ID Act").
