Filing 10 STIPULATION re #9 Letter Extension of time to Answer by Mohammed N. Alam, Jane Doe, John Doe (Spivak, Lawrence) |
Filing 9 Letter Regarding extension request by Mohammed N. Alam, Jane Doe, John Doe (Spivak, Lawrence) |
ORDER: The parties' #9 joint request for extension of time to file an answer is granted nunc pro tunc. The Court interprets the #9 letter as a request for extension as to all Defendants. Accordingly, the new deadline as to all Defendants to file an Answer is July 15, 2022. Ordered by Judge Pamela K. Chen on 7/13/2022. (Kim, Eliot) |
Filing 8 NOTICE of Appearance by Lawrence George Spivak on behalf of All Defendants (aty to be noticed) (Spivak, Lawrence) |
Filing 7 STIPULATION Extending Time to Answer by West Coast Servicing Inc. (Light, Danielle) |
ORDER: The parties' #7 stipulation extending time to answer is deficient for several reasons. First, counsel for defendants must enter a notice of appearance before representing his purported clients in proceedings, a requirement that extends to submissions of signed stipulations on ECF. Second, parties are directed to review the Court's individual rules of practice. Specifically, Rule 1.G explains that requests for extensions must be submitted in writing and include (1) the original deadline; (2) the number of previous requests for extensions; (3) whether these previous requests were granted or denied; and (4) whether the opposing counsel consents and, if not, the reasons given by the opposing counsel for refusing to consent. Rule 1.G also makes clear that requests for extension should be made at least two working days prior to the deadline. Therefore, the parties are directed to file a letter on ECF that complies with this order if they are seeking an extension of the time to answer. Finally, given that defense counsel may not yet be signed up to receive ECF notifications for this case, the Court requests that plaintiff's counsel forward the notification of this order to defense counsel. Ordered by Judge Pamela K. Chen on 6/28/2022. (Kim, Eliot) |
