June 17, 2022 Opinion or Order ORDER TO SHOW CAUSE: As courts of limited jurisdiction, federal courts have an independent obligation to examine whether subject matter jurisdiction exists. Joseph v. Leavitt, 465 F.3d 87, 89 (2d Cir. 2006); see also Pan v. Whitaker, 351 F. Supp. 3d 246, 249-50 (E.D.N.Y. 2019). "If subject matter jurisdiction is lacking, the action must be dismissed." Lyndonville Sav. Bank & Tr. Co. v. Lussier, 211 F.3d 697, 700-01 (2d Cir. 2000); see also Fed. R. Civ. P. 12(h)(3). Plaintiff's complaint #1 invokes the Court's diversity jurisdiction, but alleges that both Plaintiff and Defendant Helms Bros, Inc. are citizens of New York, and that Defendant and Richard Grein is an employee of Helms Bros. in New York, with an unknown residence. (Compl., ECF No. 1, 3-7.) This does not establish diversity citizenship under 28 U.S.C. 1332(a), which requires that the action be between citizens of different States. See El-Bey v. Brooklyn Hosp., No. 20-CV-3296 (EK) (LB), 2020 WL 7042812, at *2 (E.D.N.Y. Dec. 1, 2020) ("For a federal court to exercise diversity jurisdiction, there must be complete diversity of citizenship between the plaintiff and defendants."). In accordance with the foregoing, no later than 6/27/2022, Plaintiff is directed to show cause why this Court should not recommend dismissal for lack of subject-matter jurisdiction.
