June 17, 2022 Opinion or Order ORDER TO SHOW CAUSE: In 2021, the Supreme Court decided TransUnion LLC v. Ramirez, which established that, even where a defendant's conduct is prohibited by statute, a plaintiff might not have standing to sue in federal court if the plaintiff has not suffered an injury in fact. 141 S. Ct. 2190, 2205 (2021) ("[A]n important difference exists between (i) a plaintiff's statutory cause of action to sue a defendant over the defendant's violation of federal law, and (ii) a plaintiff's suffering concrete harm because of the defendant's violation of federal law."). To have standing, a plaintiff must allege a harm that "has a 'close relationship' to a harm traditionally recognized as providing a basis for a lawsuit in American courts -- such as physical harm, monetary harm, or various intangible harms." Id. at 2200 (quoting Spokeo, Inc. v. Robins, 578 U.S. 330, 340-41 (2016)). Plaintiffs' complaints allege that Plaintiffs are "threatened with irreparable harm" due to Defendants' actions, but do not "plead enough facts to make it plausible that [Plaintiffs] did indeed[,]" or imminently and irreparably will, "suffer the sort of injury that would entitle them to relief." Maddox v. Bank of New York Mellon Tr. Co., N.A., 19 F.4th 58, 65-66 (2d Cir. 2021) (quoting Harry v. Total Gas & Power N. Am., Inc., 889 F.3d 104, 110 (2d Cir. 2018)). Accordingly, by July 1, 2022, the Court directs Plaintiffs to show cause why this case should not be dismissed for lack of Article III standing.
