ORDER GRANTING IN PART AND DENYING IN PART #21 . (1) The City may have until 8/30/2022 to answer, because the answer is of little or no use in planning discovery. If the City intends to move against the complaint, it shall file a detailed request for a premotion conference in accordance with this Court's Individual Practice Rules by 8/19/2022. (2) The Court rejects the "stipulation" between plaintiff's lawyer and the City's lawyer to extend the time to answer of defendants who have not appeared in this case, either pro se or by counsel, and plaintiff is ORDERED to request the Clerk under Fed. R. Civ. P. 55(a) to enter the default of any defendants who have not timely responded to the complaint within 7 days of their failure to do so. (3) The Initial Telephone Status Conference is adjourned to 8/25/2022 at 11:00 am because, although the Court is not in session on that date due to vacation, the Court will have access to a telephone, which apparently the City's counsel, during his vacation, will not. The parties are reminded to comply with the mandatory requirements for the conference set forth at #4 . To participate in the call, the parties will use the toll-free number 888-684-8852 followed by access code 6427877#. When the conference begins, parties will be prompted to input the security code 3196#. (4) If plaintiff has not already served a complete set of medical authorizations and HIPAA releases on the City, as ordered on 6/1/2022, he shall do so forthwith. (5) This case has been pending since May with nothing of substance having occurred and the docket does not reflect any difficulty with service of process. Accordingly, plaintiff is advised that the failure to serve any defendant as required by Rule 4(m) will result in the dismissal of that defendant. (6) In light of plaintiff's age (at least 92), the parties can expect this case to be placed on an expedited discovery and trial schedule, part of which will require the prompt deposition of plaintiff, at the Initial Status Conference.
