July 22, 2022 Opinion or Order The July 28, 2022, Initial Status Conference is adjourned sine die. Given the Defendants' default, Parties' will no longer be required to file a joint letter describing the case and a completed civil case management plan.Instead, Plaintiff shall file a motion for default judgment on or before September 18, 2022. In addition to the service requirements of the Federal Rules of Civil Procedure, Plaintiff shall attempt to send each of the following documents, as soon as reasonably possible, directly either to Defendants or to one of Defendants' attorneys, employees, or other representatives: (i) the Clerk's Certificate of Default (ECF No. #9 ), (ii) this Order, and (iii) Plaintiff's papers in support of its motion for a default judgment. Plaintiff may not comply with this Order solely by serving copies of these documents on the New York Secretary of State. Within two business days of Plaintiff filing its motion for a default judgment, Plaintiff shall file a declaration by Plaintiff's counsel or other knowledgeable person describing Plaintiff's compliance with the notice instructions in this Order. June 3, 2022 Opinion or Order Filing 5 SCHEDULING & MEDIATION ORDER: Counsel for all parties are directed to appear before Judge Gonzalez for an initial status conference in accordance with Fed. R. Civ. P. 16 on JULY 29th, AT 11:30AM in a courtroom to be determined. The parties are directed to comply with the attached mandatory requirements, including filing on the docket a joint letter describing the case and a completed civil case management plan prior to the conference. Requests for adjournment of the initial status conference will be considered only if made in writing and otherwise in accordance with Section I.D of Judge Gonzalez's Individual Practices. The Court also feels this case would benefit from immediate mediation. Accordingly, the case is referred to the Eastern District of New York's Court-Annexed Mediation program.
