Minute Entry and Order: A telephonic Initial Conference was held on 8/10/2022 before Magistrate Judge Taryn A. Merkl. Appearances by Daniel Niamehr for Plaintiff and Aaron Schiffrik for Defendants. The parties indicated that they have already held their Rule 26(f) conference and anticipate completing the exchange of initial disclosures and relevant medical authorizations by 8/17/2022. As discussed on the record, the Court orders the parties' proposed discovery schedule, in part, as follows. First requests for documents and interrogatories shall be exchanged by 8/31/2022. Phase I discovery shall be completed by 10/31/2022. The deadline to join new parties or amend the pleadings, as of right, is 11/25/2022. The deadline to complete fact discovery is 12/30/2022, and the deadline to certify the close of fact discovery on ECF is 1/10/2023. Expert disclosures shall be exchanged by 1/31/2023, exchange of rebuttal expert disclosures shall be completed by 2/28/2023, and expert depositions shall be completed by 4/28/2023. The deadline to complete all discovery and to certify the close of all discovery on ECF is 5/5/2023. The deadline to initiate any dispositive motions in accordance with the Individual Rules of the assigned District Judge is 6/5/2023.A telephonic Status Conference will take place on 11/10/2022 at 10:00 a.m. before Magistrate Judge Merkl. The parties are directed to call the toll-free number (877) 336-1839. The access code is 3914302. The parties shall dial in five (5) minutes before the scheduled conference. In the event the parties would like to be referred to EDNY Court-annexed mediation or a pre-settlement status conference before the Court prior to the 11/10/2022 conference, they may submit a letter motion on ECF at any time.
