September 8, 2022 Minute Entry for proceedings held before Judge Kiyo A. Matsumoto: Pre Motion Conference held on 9/8/2022. Appearances: Robert Abiri, Esq. for Plaintiff and Jeffrey Jacobson, Esq. for Defendant. The Court held a pre-motion conference in Courtroom 6B South regarding Defendant's request to motion to dismiss, with the parties appearing by telephone. Rather than commencing motion practice at this time, counsel shall discuss with their respective clients the costs of proceeding with motion practice, this litigation, and the likelihood of success. Plaintiff's counsel is strongly encouraged to review Plaintiffs' claims in the complaint and consider voluntary dismissal of any claims that will not meet the standards of Federal Rule of Civil Procedure 11(b). Plaintiff shall file an amended complaint, including results from a consumer survey, by October 11, 2022. By October 18, 2022, Defendant shall advise the Court whether they intend to move to dismiss the amended complaint. If Defendant intends to move to dismiss the amended complaint, Defendant's counsel should set forth the bases on for its motion to dismiss and a mutually consented schedule consistent with the Courts Individual Practices.
