Filing 4 ORDER: The Court grants Plaintiff's #2 application to proceed in forma pauperis pursuant to 28 U.S.C. 1915(a). Because Plaintiff sues an unidentified Court Officer, the United States Marshals Service will not be able to serve this Defendant without further identifying information. Accordingly, the Court hereby requests the Office of the New York State Attorney General to ascertain the full name of the individual whom plaintiff has identified as Court Officer Jane Doe, employed at the New York Supreme Court, County of Kings, at 360 Adams Street on August 12, 2019, see Compl., ECF No. #1 at 5, and to provide the address where this Defendant can currently be served within 45 days from the date of this Order. Once this information is provided, Plaintiff's complaint shall be deemed amended to reflect the full name and shield number of this officer, a summons shall be issued and the Court shall direct service on this Defendant without prepayment of fees. As Plaintiff has sued the State of New York and the Office of Court Administration for money damages, to which they are immune, but also for injunctive relief, the Court does not determine whether these Defendants are proper parties to this action at this juncture. The Clerk of Court is directed to serve a copy of the complaint and this Order upon the Office of the New York State Attorney General and upon the Office of Court Administration at 25 Beaver Street, New York, NY 10004. Plaintiff is required to advise the Clerk of Court in writing of any change of his address. SO ORDERED by Magistrate Judge Lois Bloom, on 9/27/2022. C/mailed. (Latka-Mucha, Wieslawa) |
