ORDER According to the complaint in this civil rights action, plaintiff was racially profiled and falsely accused of shoplifting at Macy's in Yonkers, New York, and is being improperly prosecuted by the Yonkers District Attorney and subjected to improper disciplinary action by her employer, the NYPD. The Answer filed by the Yonkers defendants asserts, in the Ninth Affirmative Defense, that the "matter is improperly venued in the Eastern District of New York" (DE # 16 at paragraph 32). Although the Complaint asserts, in conclusory fashion, that the conduct complained of was "committed in the Eastern and Southern Districts of New York" (DE #1 at paragraph 2), it is not apparent from the face of the pleading that any of the alleged violations occurred in this District. Accordingly, plaintiff is directed to show cause, via ECF, by October 21, 2022, why the case should not be dismissed or transferred for improper venue Ordered by Magistrate Judge Roanne L.
